By accessing or using RailOptix, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

RailOptix provides a rail logistics management platform including shipment tracking, tariff calculations, sustainability reporting, and related services. Features vary by subscription plan.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

  • Subscriptions are billed monthly in advance
  • Prices are subject to change with 30 days notice
  • Refunds are available within 30 days of initial purchase
  • You may cancel at any time; service continues until end of billing period
  • Exceeding plan limits may result in service restrictions or upgrade requirements

5. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Share your account credentials with unauthorized users
  • Use the service to transmit malware or harmful code
  • Scrape or collect data from the service without permission

6. Data Accuracy

While we strive to provide accurate information, tariff rates and shipment data are provided "as is" and may not reflect real-time conditions. Tariff calculations are estimates and should not be used as the sole basis for customs declarations. Always consult with a licensed customs broker for official guidance.

7. Carrier Integrations

RailOptix integrates with third-party carriers. We are not responsible for carrier data accuracy, availability, or service quality. Carrier API access is subject to each carrier's terms and conditions.

8. Intellectual Property

RailOptix and its content, features, and functionality are owned by Symple Code Business Systems and are protected by copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, RailOptix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
